Florida sorts crimes into degrees. The degree sets the maximum sentence the judge can give, before any minimum mandatory or enhancement is added. A second-degree misdemeanor tops out at 60 days in jail. A first-degree felony can mean 30 years in prison.
The charge on the arrest report is often not the charge that gets filed. Prosecutors can file a lower degree, a different offense, or nothing at all, and that decision is where a defense lawyer can do the most good.
